WHEREAS, the developer of Imperial Rise III obtained a utility easement from C. Spurgeon & Luella J. Kenimer for property at 221 McCutcheon Road, also known as 416 Armor Hill Drive, for storm sewer purposes; and
WHEREAS, the sewer has been relocated and a new easement with the City has been recorded which makes the old easement with the developer obsolete; and
WHEREAS, Planning Commission did vote to recommend said vacation to Council at their April 23, 2008 meeting; and
WHEREAS, it is imperative to move forward with this vacation all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the drainage easement on property located at 221 McCutcheon Road, also known as 416 Armor Hill Drive, is hereby vacated.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
