TO AMEND SECTION 121.05, CONDITIONS OF ANNEXATION TO CITY, OF CHAPTER 121, COUNCIL, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA, AND TO DECLARE AN EMERGENCY

WHEREAS, a review of this code section was undertaken by the City Attorney as a result of a recently decided court case regarding annexation; and
WHEREAS, Council has reviewed these changes and is ready to move forward with this change; and
WHEREAS, implementation of this change is necessary for the resolution of above mentioned court case and immediate action is in the best interest of the City for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Section 121.05, Conditions of Annexation to City, of Chapter 121, Council, is hereby amended as set forth in EXHIBIT A attached hereto and made a part herein.
Section 2. That existing Section 121.05, Conditions of Annexation to City, of Chapter 121, Council, is hereby repealed.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
