TO GRANT VARIANCE FROM SECTION 1109.02(b), STREETS; FOR PROPERTY LOCATED ON MCCUTCHEON ROAD, EAST OF STYGLER ROAD, WEST OF OLDE RIDENOUR ROAD; TO VARY PAVEMENT WIDTH FROM 26' TO 19' FOR THAT PORTION OF MCCUTCHEON ROAD; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City of Gahanna, Development Department, has made application to vary Section 1109.02(b) Streets; for property located on McCutcheon Road, East of Stygler Road, and west of Olde Ridenour Road; to vary the required pavement width of 26' to 19' along that portion of McCutcheon Road; and
WHEREAS, on November 6, 2002, Planning Commission, after careful deliberation and discussion voted unanimously not to recommend approval of this variance; and
WHEREAS, under authority of Section 1103.02, this variance request must be approved by Council after a recommendation is made by Planning Commission; and
WHEREAS, it is imperative to move forward with this ordinance so that roadway construction may begin as quickly as possible; all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That under authority of Section 1103.02 this Council hereby grants variation from and exception to Section 1109.02(b) of the Codified Ordinances of Gahanna which, in part, allows for the variance of minimum pavement widths.
Section 2. That the pavement width of 19' is hereby approved for the length of McCutcheon Road east of Stygler Road and west of Olde Ridenour Road.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
