TO AMEND CODE CHAPTER 761, SOLID WASTE AND WASTE RECYCLING FACILITIES, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA.

WHEREAS, the Department of Planning and Development and environmental counsel modified Chapter 761 in 2007 in order to update all descriptions of sanitary landfills and waste disposal facilities to match current state definitions and regulations; to require annual registration of all such facilities; to increase penalties for non-compliance; and to enhance the City's authority to monitor and enforce public health and safety regulations at these facilities; and
WHEREAS, it was discovered that an incorrect version of the changes was passed in 2007 affecting Section 761.03, Cost of Inspection and Supervision; and
WHEREAS, the City Attorney has requested that the penalty section be rewritten to more closely mirror other penalty sections of our code;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Chapter 761, Solid Waste and Waste Recycling Facilities, is hereby amended as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That existing Chapter 761, Solid Waste and Waste Recycling Facilities, or any ordinances or parts of ordinances in conflict herewith, are hereby repealed.
Section 3. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
