TO AUTHORIZE THE MAYOR TO ENTER INTO SETTLEMENT AGREEMENT WITH PENNY GRANDOMINICO AND CLARK STATE DEVELOPMENT COMPANY INC. FOR SETTLEMENT OF A LAWSUIT REGARDING PROPERTY ON NORTH HAMILTON ROAD; TO SUPPLEMENTALLY APPROPRIATE $85,000 THEREFOR; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City of Gahanna wishes to reach settlement agreement with Penny Grandominico and Clark State Development Co., Inc. for settlement of a lawsuit regarding 6.817 acres along North Hamilton Road, just north of Rocky Fork Creek; and
WHEREAS, purchase of this property will give the City access to the Rocky Fork Creek from the north; and
WHEREAS, it is the intent of the City to use this flood plain land for park purposes; and
WHEREAS, it is imperative that we proceed with this legislation to settle pending litigation, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Settlement Agreement with Penny Grandominico and Clark State Development Company, Inc., for the settlement of a lawsuit regarding 6.817 acres on North Hamilton Road adjacent to Rocky Fork Creek; legal description attached as EXHIBIT A.
Section 2. That the amount of EIGHTY FIVE THOUSAND DOLLARS ($85,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.135.5463, Settlements & Judgments, to cover the herein costs.
Section 3. That ORD-0001-2000, passed January 3, 2000 is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons stated in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and signature approval by the Mayor.
