TO ZONE 1.1 ACRES, MORE OR LESS, AS ER-2, ESTATE RESIDENTIAL 2; FOR PROPERTY LOCATED AT MORSE AND HAMILTON ROADS; THE NEW ALBANY COMPANY, OWNER

WHEREAS, 1.1 acres, more or less, was recently annexed to the City of Gahanna by The New Albany Company, owner; and
WHEREAS, pursuant to Section 1133.08 of the Codified Ordinances, the owner did not file a zoning application; and
WHEREAS, Planning Commission has no leeway but to recommend ER-2 zoning for this annexed property, and on November 4, 1998, Planning Commission recommended this application for zoning as ER-2; and
WHEREAS, Council held Public Hearing on December 21, 1998, said hearing held pursuant to notice and according to law;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Official Zoning Map, adopted by Ordinance No. 198-96 on November 19, 1996, as amended, is hereby amended by zoning 1.1 acres, more or less, to ER-2, Estate Residential 2, said acreage more particularly described in EXHIBIT A attached hereto.
Section 2 . That the Clerk of Council is hereby directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.
Section 3. That this ordinance shall be in full force and effect at the earliest period allowed by law.
