TO ACCEPT INFRASTRUCTURE IMPROVEMENTS AND APPURTENANCES THERETO, FOR OAK GROVE; IMPROVEMENT NO. ST 1018 AND SA 1019; AND TO DECLARE AN EMERGENCY.

WHEREAS, in accordance with Section 1105.07 of the Codified Ordinances of the City of Gahanna, the City Engineer has certified in writing that the improvements of sanitary sewer, storm sewer and waterline, improvement no. ST 1018 & SA 1019; and appurtenances thereto, for Oak Grove, are completed and approved or that a bond or other surety has been furnished assuring construction and initial maintenance of all required improvements; and
WHEREAS, Oak Grove is a single family residential subdivision which was platted in 2014 and constructed this year; and
WHEREAS, the developer has requested that the appurtenances be accepted; and
WHEREAS, the subdivision meets the basic requirements for acceptance in that the underground utilities and roadway are complete and have passed all necessary inspections and testing; and
“WHEREAS, the City Engineer has determined the value of these appurtenances to be $284,493.40; and
WHEREAS, the immediate acceptance of these improvements is requested so house construction can begin before winter and future homeowners can move in as soon as possible, and for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the improvements of the street, sanitary sewer, storm sewer, and waterline Improvement No. ST 1018 and sanitary improvement SA 1019, and appurtenances thereto, for Oak Grove; are hereby accepted; Certificate of Completion attached as EXHIBIT A.
Section 2. That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
