TITLE
AN ORDINANCE AMENDING PART 3, TRAFFIC CODE; TITLE 9, PEDESTRIANS, BICYCLES AND MOTORCYCLES; CHAPTER 373, BICYCLES AND MOTORCYCLES, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA BY ADDING SECTION 373.11, "RIDING BICYCLES; HELMETS"
BODY
WHEREAS, the Department of Public Safety has requested that Council amend Part 3, Traffic Code; Title 9, Pedestrians, Bicycles and Motorcycles; Chapter 373, Bicycles and Motorcycles, of the Codified Ordinances by adding Section 373.11, "Riding Bicycles; Helmets,"; and
WHEREAS, the proposed amendment would create a standardized helmet requirement for all bicycle riders under the age of eighteen (18), regardless of the type or classification of bicycle; and
WHEREAS, the proposed amendment includes a parental responsibility provision under which a parent may be subject to the issuance of a citation if they aid, abet, cause, encourage, or permit conduct prohibited by the ordinance; and
WHEREAS, the proposed Section 373.11 is written to closely mirror the bicycle helmet regulations currently in place in the City of New Albany, creating consistency among neighboring communities.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That Part 3, Traffic Code; Title 9, Pedestrians, Bicycles and Motorcycles; Chapter 373, Bicycles and Motorcycles, of the Codified Ordinances of the City of Gahanna is hereby amended by adding Section 373.11, "Riding Bicycles; Helmets," as set forth in EXHIBIT A, attached hereto and incorporated herein by reference.
Section 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
