TO AUTHORIZE THE MAYOR TO ENTER INTO PARTICIPATION AGREEMENT WITH THE GAHANNA-JEFFERSON SCHOOL DISTRICT FOR THE DEPLOYMENT OF TELECOMMUNICATIONS FACILITIES AS PART OF THE EXPANSION OF THE INTELLIGENCE TRANSPORTATION SYSTEM, IMPROVEMENT NO. 744; AND TO DECLARE AN EMERGENCY.

WHEREAS, the public interest demands the deployment of optical telecommunications infrastructure; and
WHEREAS, the City of Gahanna has plans to deploy fiber optic telecommunications as a part of the expansion of the Intelligent Transportation System; and
WHEREAS, the City of Gahanna through the Mayor and City Council, and Gahanna-Jefferson School District through the Board of Education do mutually intend to cooperate in the planning, design and construction and to share the cost and expense of the improvements; and
WHEREAS, it is imperative to move forward with this agreement all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Gahanna-Jefferson School District hereby authorizes Gahanna to act as its agent for the deployment of telecommunications infrastructure and facilities as a part of Improvement No. 744, attached as EXHIBIT A.
Section 2. That the Mayor is hereby authorized to enter into Participation Agreement with the Gahanna-Jefferson School District for the deployment of Telecommunications Facilities, Improvement No. 744.
Section 3. That for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on the date of signature approval by the Mayor.
