TO AUTHORIZE THE MAYOR TO ENTER INTO AN AMENDED AGREEMENT WITH JOHN ROYER AND DOUG MADDY FOR THE SALE OF CITY OWNED LAND LOCATED AT 57-63 MILL STREET; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0231-2001 authorized the sale of 57-63 Mill Street to John Royer and Doug Maddy; and

 

WHEREAS, ORD-0074-2002 amended said agreement to allow for an extension of time before the sale was complete; and

 

WHEREAS, in the process of authorizing funding for a flood study to be done the City Attorney determined that the contract had expired; and

 

WHEREAS, terms as to the payment of the flood study are covered in the revised agreement; and

 

WHEREAS, it is imperative to proceed immediately so that construction can begin during the building season, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into amended agreement with John Royer and Doug Maddy, for sale of city owned land located at 57-63 Mill Street, in accordance with the real estate purchase contract attached hereto as EXHIBIT A.

 

Section 2.  That, for the reasons set for the in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
