TO AUTHORIZE THE MAYOR TO ENTER INTO PURCHASE AGREEMENT WITH THE HEIRS OF THE ANNA MAE SMITH ESTATE, 1.27 ACRES AT 4390 CHERRY BOTTOM ROAD; TO SUPPLEMENTALLY APPROPRIATE $102,000; AND TO DECLARE AN EMERGENCY

WHEREAS, the property at 4390 Cherry Bottom Road is in probate and the children would like to sell the property to the City of Gahanna, since it is adjacent to Academy Park; and

 

WHEREAS, the City needs a portion of this property for right-of-way purposes to run a water line immediately, and will need it in the future for the bike path and eventually for culvert work; and

 

WHEREAS, it is imperative that the City proceed with this purchase all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Purchase Agreement with the heirs of the Anna Mae Smith Estate, for the purchase of 1.27 acres, 4390 Cherry Bottom Road.

 

Section 2.  That the amount of One Hundred Two Thousand Dollars ($102,000) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the General Fund, to Account No. 651.350.5596, Water Line Improvement, to cover the herein costs.

 

Section 3.  That ORD-0001-2000, passed January 3, 2000, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
