TO VACATE A PORTION OF A WATERLINE EASEMENT FOR PROPERTY LOCATED AT 207 HIGHMEADOW DRIVE; AND TO DECLARE AN EMERGENCY.

WHEREAS, a waterline easement exists on property located at 207 Highmeadow Drive and the existing home encroaches on this easement; and
WHEREAS, the waterline has been relocated and a partial release of the easement needs to be accomplished; and
WHEREAS, Planning Commission did vote to recommend said vacation to Council at their June 25, 2008 meeting; and
WHEREAS, it is imperative to move forward with this vacation all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That a portion of the waterline easement on property located at 207 Highmeadow Drive, is hereby vacated as described and shown on EXHIBIT A attached hereto.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
