WHEREAS, the Administration previously recommended a code change to Chapter 1195, Soil Erosion and Sedimentation Policy, and said change was implemented by ORD-0021-2010; and
 
WHEREAS, upon review there were editing issues with Section 1195.04, Sediment and Erosion Control Standards and Criteria, that should be addressed prior to codification; and
 
WHEREAS, it is important to get this legislation in place prior to the end of the year so that it may be codified at the same time as ORD-0021-2010, all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That Section 1195.04, Sediment and Erosion Control Standards and Criteria, of Chapter 1195, Soil Erosion and Sedimentation Policy, is hereby amended as set forth in EXHIBIT A, attached hereto and made a part herein.
 
Section 2. That existing Section 1195.04, Sediment and Erosion Control Standards and Criteria, or any ordinances or parts of ordinances in conflict herewith, are hereby repealed.
 
Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
