TO AUTHORIZE THE MAYOR TO ENTER INTO AMENDED CONTRACT WITH HOCKADEN & ASSOCIATES FOR PURCHASE AND PAYMENT FOR RIGHT OF WAY ON JAMES ROAD FOR RECONSTRUCTION OF THE JAMES ROAD BRIDGE; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0027-2003 authorized a contract with Hockaden & Associates for right of way acquisition for the James Road Bridge Improvement, Imp. #819; and
WHEREAS, the negotiations are now complete and authorization is now needed to purchase and pay for this right of way; and
WHEREAS, it is prudent to proceed to authorize the purchase of this property at this time for the continuation of the orderly redevelopment of the west side and the continued flow of traffic on James Road, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into amended contract with Hockaden and Associates, Inc., 883 N. Casssady Avenue, Columbus, Ohio 43219 for the purchase and payment for right of way for the James Road Bridge Improvement, Imp. #819 as shown on EXHIBIT A attached hereto.
Section 2. That the amount of EIGHT THOUSAND DOLLARS ($8,000) was appropriated to Account #101.145.5541, Capital Projects, Streets, in the 2003 appropriations for this acquisition.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
