WHEREAS, application has been made by Albert and Jessie Hamm, to rezone 5.1+/- acres, more or less, to L-AR, Limited Overlay Multi Family Residential; and

 

WHEREAS, Planning Commission held public hearing, said hearing held pursuant to notice and according to law and, as a result of such hearing and deliberations, on February 22, 1995, Planning Commission recommended this application for rezoning; and

 

WHEREAS, on April 18, 1995, this Council held public hearing, said hearing pursuant to notice and according to law; and

 

WHEREAS, Council also held public hearing on December 4, 2000, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Official Zoning Map, adopted by Ordinance No. 198-96 on November 19, 1996, as amended, is hereby amended by zoning 5.1+/- acres, more or less, to L-AR Limited Overlay Multi Family Residential, said acreage more particularly described in EXHIBIT A attached hereto and made a part herein.

 

Section 2.  That the use and development of the referenced property is limited as per the development plan text required by Section 1152.02(d), Development Plan, of Chapter 1152, Overlay Districts, said development plan attached to this ordinance as EXHIBIT B.

 

Section 3.  That the site plan as required by Section 1152.02(d), Development Plan, of Chapter 1152, Overlay Districts, is attached to this ordinance as SECTION 2 of EXHIBIT B.

 

Section 4.  That the Clerk of Council is hereby directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.

 

Section 5.  That this ordinance shall be in full force and effect at the earliest period allowed by law.
