WHEREAS, an easement is required across land not in possession of the City for the storm sewer improvement to the Armor Hill Project, Imp. No. 992; and

 

WHEREAS, authorization is needed to purchase this easement; and

 

WHEREAS, it is prudent to proceed to authorize the purchase of this easement at this time for the orderly construction of these improvements, and all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into contract with C. Spurgeon and Luella J. Kenimer for the purchase and payment for storm sewer easement for property owned by C. Spurgeon and Luella J. Kenimer as shown on EXHIBIT A attached hereto.

 

Section 2.  That the City will pay ONE DOLLAR ($1) and replace the existing asphalt driveway with a 6" thick concrete driveway as full compensation and damages to cover the herein costs.

 

Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
