TO AUTHORIZE THE MAYOR TO ENTER INTO ADDENDUM AGREEMENT WITH TIME WARNER COMMUNICATIONS FOR FIVE (5)YEAR EXTENSION TO OPERATE A COMMUNITY ANTENNA (CATV) SYSTEM IN THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY

WHEREAS, the cable service franchise issued to Time Warner Entertainment Company, L.P., allows that the City of Gahanna may be petitioned once for a five (5) year Term Extension in Section XXXVII; and
WHEREAS, on March 15, 2000, Time Warner sent written notice to the Mayor of the City of Gahanna requesting extension of their franchise for a five (5) year period; and
WHEREAS, the Cable Advisory Board has recommended approval of this contract extension;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the cable franchise issued to Time Warner Entertainment Company, L.P. (n.k.a. Time Warner Communications Inc.) by Ordinance 153-92 shall be extended for an additional term of five (5) years, with the franchise agreement expiring July, 6, 2007.
Section 2. That the cable franchise issued to Time Warner Entertainment Company, L.P., by the Gahanna City Council on July 7, 1992, by Ordinance 153-92, and currently held by Time Warner Communications, shall be and hereby is amended to include the terms of this ordinance as if this ordinance were fully rewritten therein.
Section 3. That this ordinance shall be in full force and effect upon passage by this Council and thirty days after signature by the Mayor.
