Title

TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH AMERITECH NEW MEDIA, INC.; TO PERMIT AMERITECH NEW MEDIA, INC.; TO PERMIT AMERITECH NEW MEDIA, INC., TO OPERATE A CABLE TELEVISION SYSTEM IN THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY.

Body

WHEREAS, Ameritech New Media, Inc., is desirous of constructing, owning, and operating a cable television system to serve the residents of Gahanna; and

WHEREAS, this Council deems it appropriate and desirable to introduce competition in to the cable television marketplace in the City of Gahanna to provide additional consumer protection and to ensure the availability of state-of-the-art technology to Gahanna residents;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the Mayor is authorized to enter into Agreement with AMERITECH NEW MEDIA, INC., 300 South Riverside Plaza, Suite 1800N, Chicago, Illinois 60606, to operate a Cable Television System in the City of Gahanna, said Agreement attached to this ordinance as EXHIBIT A, and made a part herein.

Section 2. That a Permit is hereby granted to AMERITECH NEW MEDIA, INC., 300 South Riverside Plaza, Suite 1800N, Chicago, Illinois 60606, to operate a Cable Television System in the City of GAhanna in accordance with EXHIBIT A, hereto.

Section 3. That if a Fifteen-year non-exclusive franchise agreement between Ameritech New Media, Inc., and the City of Gahanna has not been executed by the parties and delivered to the City of Gahanna by thirty (30) days after the effective date of this ordinance, said agreement is null and void and of no further legal force and effect.

Section 4. That should any terms of this Agreement be in conflict with Chapter 751 of the Codified Ordinances of the City of Gahanna, this Agreement shall prevail.

Section 5. That any ordinances or parts of ordinances, or any permits in conflict herewith are hereby repealed.
