TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH KOKOSING CONSTRUCTION COMPANY FOR THE 2008 ASPHALT OVERLAY PROGRAM, AND DUNBARTON ROAD REBUILD; IMPROVEMENT NO. 928; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids for the 2008 Asphalt Overlay Program were opened on May 16, 2008, pursuant to Council authorization, and the best, responsible and responsive bidder has been recommended by the City Engineer; and
WHEREAS, it is desirable to proceed with this contract at the earliest possible date due to the pending construction season, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is authorized to award and the Mayor is authorized to enter into contract with KOKOSING CONSTRUCTION COMPANY, 6235 Westerville Road, Westerville, OH 43081, for the 2008 Asphalt Overlay Program and Rebuild of Dunbarton Road; Improvement No. 928, in accordance with bid and City specifications; bid tabs attached as EXHIBIT A.
Section 2. That funding in the amount of EIGHT HUNDRED TWENTY EIGHT THOUSAND NINE HUNDRED SIXTY SIX DOLLARS ($828,966) was set aside in the 2008 Appropriations to Account No. 101.145.5513, Engineering, Streets to cover the herein costs.
Section 3. That funding in the amount of TWO HUNDRED THIRTY FOUR THOUSAND EIGHTY FIVE DOLLARS ($234,085) was set aside in the 2008 Appropriations to Account No. 325.122.5596, Capital Projects/Improvements to further cover the herein costs.
Section 4. That funding in the amount of SEVEN THOUSAND DOLLARS ($7,000) was set aside in the 2008 Appropriations to Account No. 860.343.5420, Developer's Escrow, to further cover the herein costs.
