TO AUTHORIZE THE MAYOR TO ENTER INTO MEMORANDUM OF UNDERSTANDING WITH THE FRATERNAL ORDER OF POLICE, CAPITAL CITY LODGE NO. 9; FOR CHANGE TO ARTICLE 14, PROMOTIONS, OF THE BARGAINING UNIT AGREEMENT; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0165-2012, passed October 18, 2010, established salary and benefits for the FOP employees of the City of Gahanna; and
 
WHEREAS, under the terms of the existing labor agreement, negotiations were undertaken to open discussion on Promotional Testing; and
 
WHEREAS, the Department of Human Resources currently handles all other testing for employment in the City; and
 
WHEREAS, the FOP and the Administration have come to an agreement on future promotional testing, to change promotional testing for Sergeant and Lieutenant from the responsibility of the Civil Service Commission to the Department of Human Resources; and
 
WHEREAS, it is imperative to proceed with this change as there may be a need to test for Police Sergeant in January of 2013, and the Human Resources Department needs time to prepare, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into Memorandum of Understanding with The Fraternal Order of Police, Capital City Lodge No. 9, to change Article 14 of the current contract, Promotions; to be the responsibility of the  Human Resources Department; MOU attached as EXHIBIT A, and made a part herein.
 
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
