TO AUTHORIZE A REIMBURSEMENT TO VALUE RECOVERY GROUP FOR FUNDS EXPENDED ON REMOVAL OF ABANDONED FUEL TANKS; TO SUPPLEMENTALLY APPROPRIATE FUNDS THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, a portion of our fuel site was traded to VRG for the Golf Depot, and the conditions of the swap were that the City would pay for the removal of abandoned fuel tanks on the property transferred to VRG; and
WHEREAS, because the construction of the Golf Depot actually preceded the Fuel Site demolition it was necessary for VRG to remove the tanks and receive reimbursement from the City at a total cost being $38,877; and
WHEREAS, it is in the best interest of the City to make the reimbursement as quickly as possible, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That in accordance with the agreement approved by ORD-0036-2011, reimbursement to Value Recovery Group is hereby authorized.
Section 2. That funding in the amount of THIRTY EIGHT THOUSAND EIGHT HUNDRED SEVENTY SEVEN DOLLARS ($38,877) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Tax Increment Equivalence Fund to Account No. 224.343.5596, TIZ Capital Projects/Improvements.
Section 3. That ORD-0001-2011, passed January 3, 2011, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
