TO AUTHORIZE THE CITY ATTORNEY TO PETITION THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY, OHIO, TO ANNEX CERTAIN 5.55+/- ACRE TRACT OF LAND, EAST JOHNSTOWN ROAD, FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA, SAID LAND BEING COMPRISED OF ROAD RIGHT OF WAY; AND TO DECLARE AN EMERGENCY.

WHEREAS, it is the desire of the City of Gahanna to annex a certain portion of roadway right of way to obtain the four segments of East Johnstown Road not incorporated from Hamilton to Morse Road; and

 

WHEREAS, a legal description has been developed and it is necessary to proceed at the earliest possible date to annex this parcel for orderly development of this growth area of the City; and

 

WHEREAS, Section 709.14 of the Ohio Revised Code requires that a representative be appointed by the City to prosecute said annexation proceedings; and

 

WHEREAS, an emergency exists in the usual daily operation of the City to immediately annex the herein described land, thereby preserving the public peace, health, safety and welfare of the residents:

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That it is necessary and in the best interest of the City of Gahanna to annex 5.55+/- acres of roadway right of way, East Johnstown Road, said acreage more particularly described in EXHIBIT A, attached to this ordinance and made a part herein.

 

Section 2.  That the City Attorney is authorized and directed to effect all documentation necessary for the completion of this annexation before the Board of County Commissioners of Franklin County, Ohio.

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency  legislation and shall be in full force and effect immediately after passage by this Council and upon the date of signature approval by the Mayor.
