TO AUTHORIZE THE WAIVER OF REQUIREMENTS OF GAHANNA CITY CODE SECTION 929.14, WATER SYSTEM CAPACITY RATES AND CODE SECTION 921.04 SEWER SYSTEM CAPACITY RATES, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA, TO ALLOW A ONE TIME 50% REDUCTION OF CAPACITY FEES FOR NIAGARA BOTTLING LLC.

WHEREAS, the City of Gahanna is in the process of approving an Office & Industrial Incentive agreement with Niagara Bottling, LLC, and because of the anticipated high volume of their water/sewer capacity fees use the City of Gahanna wishes to grant Niagara Bottling a one time 50% reduction of capacity fees; and
WHEREAS, the annual volume of water that Niagara Bottling, LLC anticipates purchasing from the City of Gahanna equates to revenues of approximately 4.5% of the total water revenues collected in 2011; and
WHEREAS, this infusion of revenue on a regular basis will be helpful toward stabilizing the water fund for all Gahanna customers while supporting infrastructure installation and maintenance;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the City of Gahanna hereby grants a waiver of requirements of Gahanna City Code Section 929.14, Water System Capacity Rates, and Code Section 921.04, Sewer System Capacity Rates, of the Codified Ordinances, to allow a one time 50% reduction of capacity fees for Niagara Bottling, LLC, 2560 E. Philadelphia Street, Ontario, CA 91761.
Section 2. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
