WHEREAS, the City of Gahanna wishes to reach settlement agreement with Kanwal and Lynn Singh, and purchase the 25.411 acres along Taylor Road, known as the Singh Property; and

 

WHEREAS, purchase of this property will give the City complete access to the East Industrial Sewer and will nullify the need for a Temporary Pump Station; and

 

WHEREAS, it is imperative that we proceed with this legislation to obtain the property for necessary work on the East Industrial Sewer, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Settlement Agreement with Kanwal N. and Lynn W. Signh, 2701 Indianola Avenue, Columbus, Ohio 43202, for the purchase of 25.411 acres on Taylor Road, known as the Singh Property; legal description attached as EXHIBIT A.

 

Section 2.  That the amount of FIVE HUNDRED FIFTY THOUSAND DOLLARS ($550,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.135.5463, Settlements & Judgments, to cover the herein costs.

 

Section 3.  That ORD-0001-2000, passed January 3, 2000 is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons stated in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and signature approval by the Mayor.
