TO ACCEPT DEED OF EASEMENT FOR 1.076 ACRES AND 0.903 ACRES OF LAND; PROPERTY LOCATED AT 975 AND 1025 NORTH HAMILTON ROAD; FROM ACADEMY DEVELOPMENT LIMITED PARTNERSHIP; FOR UTILITY PURPOSES AND ESTABLISHMENT OF PRESERVATION AREAS; TO AUTHORIZE THE MAYOR TO SIGN A LETTER OF AGREEMENT REGARDING THE BEECHER ROAD ACCESS; AND TO DECLARE AN EMERGENCY

WHEREAS, the City of Gahanna has received a Deed of Easement for utility purposes and to establish preservation areas from Academy Development Limited Partnership for property located at 975 and 1025 North Hamilton Road containing 1.076 acres and 0.903 acres; and
WHEREAS, this deed of easement includes restrictions on the removal of trees and grading of the site other than for installation of said utilities without authorization by the City of Gahanna, and
WHEREAS, the City is committing to providing an access point on Beecher Road for future development of the site; and
WHEREAS, this deed of easement will be recorded at the Franklin County Recorder's office upon passage of this ordinance; and
WHEREAS, the City Engineer has determined the value of these easements to be $45,000 for the 0.903 acres and $54,000 for the 1.076 acres; and
WHEREAS, it is desirable to accept this Deed of Easement; and
WHEREAS, it is desirable to complete this transfer so that the project approved on the south parcel may move forward, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the DEED OF EASEMENT for the purpose of a utility easement and to establish preservation areas for property located at 975 and 1025 North Hamilton Road containing 1.076 acres and 0.903 acres; said Deed of Easement attached to this ordinance as EXHIBIT A, and made a part herein.
