TO AUTHORIZE THE MAYOR TO EXECUTE DEEDS TO CREATE A DEDICATED RIGHT OF WAY FOR THE RIVA RIDGE EXTENSION; AND TO DECLARE AN EMERGENCY.

WHEREAS, the development of property at 4541 East Johnstown Road requires an extension of Riva Ridge Boulevard to provide access for a condo development as well as to other properties in the area; and

 

WHEREAS, the intersection is planned to be signalized as part of a city capital improvements project; and

 

WHEREAS, these deeds are required to be executed so that the property owner will then execute his deed for right of way; and

 

WHEREAS, it is desirable and necessary to complete this transaction as soon as possible in order to allow for the developments on property at 4541 East Johnstown Road, and for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to execute the necessary deeds to create a dedicated right of way for the Riva Ridge extension, as outlined in the legal description and survey attached hereto as EXHIBIT A.

 

Section 2.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
