TO AUTHORIZE THE MAYOR TO EXECUTE EASEMENT WITH GEORGE W. WEBER, JR., FOR 2.731 ACRES OF PROPERTY LOCATED AT 258 JAMES ROAD, GAHANNA; FOR A RECREATIONAL MULTI-USE TRAIL; TO REPEAL ORD-0192-2008; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City has requested an easement for land for a recreational multi-use trail at 258 James Road; and

 

WHEREAS, the property owner has agreed to grant easement to this property so that the City can begin work on a recreational multi-use trail; and

 

WHEREAS, the easement attached to ORD-0192-2008 had restrictive language which should not have been included; and

 

WHEREAS, it is imperative to move forward so that construction can begin this year on the trail, and all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to execute easement with George W. Weber for 2.731 acres of property located at 258 James Road for a recreational multi-use trail; as described in EXHIBIT A and EXHIBIT B, attached hereto and made a part herein.

 

Section 2. That second reading is hereby waived.

 

Section 3.  That ORD-0192-2008 is hereby repealed.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
