WHEREAS, ORD-0140-2002 authorized an agreement with Old Bag Investment Company, LLC regarding the property at 57-63 Mill Street; and
WHEREAS, said agreement calls for the re-conveyance of the Public Areas to the City at a cost of $110,000; and
WHEREAS, said agreement also calls for restrictive covenants and an easement at a cost of $43,000 whereby no changes may be made to the exterior facades of such buildings without the prior written consent of the City; and
WHEREAS, a supplemental appropriation is required in order to make the payment to Old Bag Investment Company, LLC:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That funding in the amount of ONE HUNDRED FIFTY THREE THOUSAND DOLLARS ($153,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance in the General Fund to Account No. 101.343.5511, Development, Capital Projects.
Section 2. That ORD-0001-2003, passed January 2, 2003, is hereby amended to reflect his supplemental appropriation.
Section 3. That this ordinance shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
