TO AUTHORIZE THE MAYOR TO ENTER INTO AN EASEMENT AND MAINTENANCE AGREEMENT WITH BONITA25 REAL ESTATE INVESTORS LLC AND TO DECLARE AN EMERGENCY.

WHEREAS, the City wishes to grant certain easements to Bonita25 Real Estate Investors LLC for installation, operation, maintenance and repair of a graded slope on the Bonita25 property as more fully described in this Agreement and on the terms set forth herein;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, AND STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Easement and Maintenance Agreement with Bonita25 Real Estate Investors LLC; Easements and Exhibits A, B, C, D and E, attached hereto and made a part herein.
Section 2. That said Easements will be granted in exchange for consideration in the amount of TWENTY-ONE THOUSAND, TWO-HUNDRED SEVENTY DOLLARS AND FIFTY CENTS ($21,270.50).Section 2. That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
Section 3. That this Ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
