TO AUTHORIZE THE MAYOR TO EXECUTE SANITARY SEWER EASEMENT TO CONTINENTAL/EAGLE IV, LLC, FOR CONSTRUCTION OF A SANITARY SEWER ON THE GIANT EAGLE PROPERTY; AND TO DECLARE AN EMERGENCY.

WHEREAS, Continental/Eagle IV, LLC, will be building a sanitary sewer on the Giant Eagle property, and when this sewer is complete it will be dedicated to the City; and
WHEREAS, to accomplish this it is necessary to execute a sanitary sewer easement over City owned property; and
WHEREAS, it is imperative to move forward with this all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Sanitary Sewer Easement to Continental/Eagle IV, LLC, to build a sewer on property owned by the City; said Easement attached hereto as Exhibit A.
Section 2. That upon completion, this sanitary sewer will be dedicated to the City.
Section 3. That, for the reasons stated in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
