WHEREAS, right of way is needed for the West Gahanna Sanitary Sewer Project and settlement has been reached with the property owner; and
 
WHEREAS, it is imperative to move forward with this Settlement so that the project can begin as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into Settlement with KEITH T. & NANCY JEAN GAYER, 414 Debra Lane, Gahanna, Ohio 43230, for permanent right of way needed for the West Gahanna Sanitary Sewer Project Improvement No. SA944; Legal Description, Survey map and Negotiation Summary attached as EXHIBIT A and made a part herein.
 
Section 2.  That funding in the amount of TWO THOUSAND NINE  HUNDRED FIFTY DOLLARS ($2,950) was set aside in the 2010 Appropriations to Account No. 662.361.5596, Sewer System Capital Improvements/Projects, to cover the herein costs.
 
Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
