TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH CONIE CONSTRUCTION COMPANY FOR THE RICE AVENUE BASIN PROJECT; AND TO DECLARE AN EMERGENCY.

WHEREAS, the Army Corps of Engineers has granted approval for the City to proceed with the Rice Avenue Basin project; and
WHEREAS, the Department of Parks & Recreation is recommending that we move forward with a contract with Conie Construction to pump, dredge, and fill the lower pond of the Rice Avenue project located on Preservation Way; and
WHEREAS, the Department would like to move forward with this portion of the work yet this year while bidding out the remaining portions of this project over the winter months for completion in the spring of 2009; and
WHEREAS, it is imperative to move forward with this project to improve storm water detention and complete this portion of the project while it is still desirable excavation weather, and all for the preservation of the public, peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is authorized to enter into contract with CONIE CONSTRUCTION COMPANY, 1340 Windsor Avenue, Columbus, Ohio 43211, for the Rice Avenue Basin Project; in accordance with proposal attached hereto as EXHIBIT A.
Section 2. That funding in the amount of TWENTY FIVE THOUSAND DOLLARS ($25,000) has been set aside from bond proceeds approved by ORD-0097-2007 to Account No. 631.350.5596, Stormwater, Water, Capital Projects, Improvements, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
