TO AUTHORIZE THE MAYOR TO ENTER INTO SETTLEMENT AGREEMENT WITH DONALD E. & JUDY A. SPIRES, 527 EAST JOHNSTOWN ROAD, FOR SANITARY SEWER EASEMENT NEEDED FOR THE LARRY LANE SANITARY SEWER EXTENSION; IMPROVEMENT NO. SA 1013; AND TO DECLARE AN EMERGENCY.

WHEREAS, sanitary sewer easement is needed across the property of Donald E.and Judy A. Spires, 527 East Johnstown Road, for the Larry Lane Sanitary Sewer Extension, Improvement No. SA 1013, and settlement has been reached with the property owner; and
WHEREAS, it is imperative to move forward with this Settlement so that the project can begin as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Settlement Agreement with Donald E. and Judy A. Spires, 527 East Johnstown Road, Gahanna, Ohio 43230, for sanitary sewer easement for the Larry Lane Sanitary Sewer Extension; Improvement No. SA 1013; Legal Description, Survey map and Contract of Sale and Purchase attached as EXHIBIT A and made a part herein.
Section 2. That funding in the amount of EIGHT HUNDRED FORTY DOLLARS ($840) was set aside in the 2014 Appropriations to Account No. 662.361.5476, Sewer Capital Maintenance, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble hereto and incorporated herein by this reference, this Ordinance is declared emergency legislation and will be in full force and effect upon passage by this Council and the signature approval by the Mayor.
