TO AUTHORIZE THE MAYOR TO EXECUTE AN EASEMENT FOR AN ONSITE SANITARY SYSTEM TO WILLIAM F. AND PAMELA J. TYLKA, FOR AN ONSITE SANITARY SYSTEM ON CITY OWNED PROPERTY KNOWN AS HANNAH FARM PARK; AND TO DECLARE AN EMERGENCY.

WHEREAS, William F. and Pamela J. Tylka purchased the house on the Hannah Farm Park property; and
WHEREAS, this home is serviced with an onsite sanitary sewer system flowing into field tiles located on the park property; and
WHEREAS, it is incumbent upon the City to provide an easement on the park property for this system; and
WHEREAS, this easement shall revert to the City should the property be connected to a municipal sewage system; and
WHEREAS, it is imperative to move forward with this in a timely fashion all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Deed of Easement for Onsite Sanitary Sewer System to William F. and Pamela J. Tylka for operation of an onsite sanitary sewer system on property owned by the City; said Easement attached hereto as Exhibit A.
Section 2. That this easement shall revert to City should the Tylka property be connected to a municipal sewage system.
Section 3. That, for the reasons stated in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
