Title
TO VACATE AN EASEMENT FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF DEFFENBAUGH COURT AND EASTGATE PARKWAY IN THE EASTGATE BUSINESS CENTER; AND TO DECLARE AN EMERGENCY.
 
 
Body
WHEREAS, the Final Development Plan for the Eastgate Business Center was approved by Planning Commission on February 3, 2014 and includes relocating a small stream on the site; and
 
WHEREAS, the Developer has obtained the necessary approvals from the Corps of Engineers and is now ready to begin construction; and
 
WHEREAS, the stream was included in a drainage easement on the plat, and to relocate the stream will require vacating the old easement and creating a new one for the relocated stream; and
 
WHEREAS, it is imperative that the current easement be vacated as soon as possible due to the construction season, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
 
Section 1.  That the easement on the southeast corner of Deffenbaugh Court and Eastgate Parkway at the Eastgate Business Center, is hereby vacated; more particularly described in EXHIBIT A attached to this ordinance and made a part herein.
 
Section 2.  That the Mayor is hereby authorized to sign a Quit Claim Deed for the vacated portion of land.
 
Section 3.  That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
