Title

TO VACATE ALL OF BROOK HOLLOW COURT AS A PUBLIC ROADWAY; WITH UTILITY EASEMENTS TO BE MAINTAINED; CONSISTING OF APPROXIMATELY 0.214 ACRES.

 

Body

WHEREAS, Select Properties has a pending rezoning of property located on Brook Hollow Court which negates the need for this street to be a public street; and

 

WHEREAS, the idea of this vacation of right of way was discussed in conjunction with the rezoning application; and

 

WHEREAS, Select Properties has requested the City vacate all of Brook Hollow Court as a public roadway for the harmonious development of the property; and

 

WHEREAS, the Planning Commission has reviewed this request and at their regular meeting held March 11, 1998 recommended to Council that all of Brook Hollow Court be vacated as a public roadway except that utility easements be maintained; and

 

WHEREAS, the City Engineer has stated that these portions of roads could be vacated as a public road except for utility easements in the right of way of said road;

 

NOW, THEREFORE, BE  IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That all of Brook Hollow Court except for utility easements is hereby vacated as a public roadway, said roadway more particularly described in EXHIBIT A and EXHIBIT B, attached to this ordinance and made a part herein.

 

Section 2.  That Brook Hollow Court shall be maintained in its entirety as a private road and that utility easements as currently exist shall remain.

 

Section 3.  That this ordinance shall be in full force and effect at the earliest period allowed by law.
