TO AUTHORIZE THE MAYOR TO ENTER INTO LEASE AGREEMENT WITH JOHN R. ECKARD II AND ROBIN S. ECKARD; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0200-2006 authorized the purchase of the property at 537 North Hamilton Road; and

WHEREAS, the owner is requesting to reside at this property until he is able to find new residence and has agreed to limit that time to a maximum of 3 years; and

WHEREAS, it is imperative to move forward with this lease in order to purchase the property while the owner is willing to sell, all for the preservation of the public peace, health, safety and welfare.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the Mayor is hereby authorized to enter into Lease Agreement for property located at 537 North Hamilton Road, with John R. Eckard II and Robin S. Eckard for the amount of ONE DOLLAR ($1), said Lease Agreement attached hereto as EXHIBIT A, and made a part herein.

Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance shall be deemed emergency legislation and shall be in full force and effect after passage by this Council and upon date of signature approval by the Mayor.
