TITLE
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A PRE-ANNEXATION AGREEMENT WITH JIMMIE TONEY, DARLENE TONEY, AND TRIVIUM DEVELOPMENT, LLC FOR PARCELS 170-000068-00 AND 170-000069-00; AND WAIVING SECOND READING

WHEREAS, the City of Gahanna has been approached by representatives of Jimmie Toney and Darlene Toney, owners of 4722 and 4736 East Johnstown Road, Franklin County Auditor Parcel Nos. 170-000068-00 and 170-000069-00, regarding a request to annex their properties into the City from Jefferson Township; and

 

WHEREAS, the two parcels, totaling approximately eight (8) acres, are included in the Gahanna Land Use Plan as designated Community Commercial land; and

 

WHEREAS, the Landowner and Developer intend to pursue General Commercial (GC) zoning with a Limited Overlay District following annexation, consistent with preliminary conceptual plans; and

 

WHEREAS, the proposed development aligns with the City’s goals for the Johnstown Road/Morse Road area and supports economic development consistent with the Land Use Plan; and

 

WHEREAS, the Pre-Annexation Agreement outlining the annexation process, zoning considerations, and development expectations is attached hereto as EXHIBIT A.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1. The Mayor is hereby authorized to execute the Pre-Annexation Agreement with Jimmie Toney, Darlene Toney, and Trivium Development, LLC; said agreement attached hereto and incorporated herein as EXHIBIT A.

 

Section 2. The second reading is hereby waived.

Section 3. This ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
