TO ACCEPT DEED OF EASEMENT IN THE AREA OF 416 ARMOR HILL DRIVE, ALSO KNOWN AS 221 MCCUTCHEON ROAD, FOR A STORM SEWER EASEMENT FROM C. SPURGEON & LUELLA J. KENIMER, OWNERS; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City has received a Deed of Easement for storm sewer easement in the area of 416 Armor Hill Drive, said property also known as 221 McCutcheon Road; and

 

WHEREAS, the City Engineer has determined the value of this easement to be $500; and

 

WHEREAS, this deed of easement was recorded by the Franklin County Recorder's office on April 3, 2008; and

 

WHEREAS, it is desirable and necessary to accept this Deed of Easement, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:   

 

Section 1.  That this Council hereby accepts this Deed of Easement for the purpose of constructing, operating , maintaining or replacing a storm sewer and appurtenant work thereto in the area of 416 Armor Hill Drive; owners C. Spurgeon & Luella J. Kenimer; Deed attached as EXHIBIT A, and made a part herein.

 

Section 2.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
