TO AUTHORIZE THE MAYOR TO EXECUTE QUITCLAIM DEED OF ENCROACHMENT EASEMENT FOR PROPERTY AT 132 SHEPARD STREET TO LEGALLY PERMIT RIGHT-OF-WAY ENCROACHMENT OF WALNUT STREET; AND TO DECLARE AN EMERGENCY.

WHEREAS, the property owner at 132 Shepard St. is trying to sell the house and it was discovered that the house encroaches on the right-of-way of Walnut St; and
WHEREAS, the encroachment has been there for most of the 20th century and is not an impediment to the use of City right-of-way; and
WHEREAS, executing an encroachment easement to legally permit the encroachment will allow the homeowner to sell the house and obtain a clear title; and
WHEREAS, it is imperative to move forward with this easement so that the house can be sold and the issue settled as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Quitclaim Deed of Encroachment Easement for the property at 132 Shepard Street to legally permit encroachment on the City right-of-way; Quitclaim Deed of Encroachment Easement attached as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
