Title

TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH STILLION BROTHERS EXCAVATING TO DREDGE THE POND ON THE PROPERTY OF CAPITAL CITY LODGE #9, FRATERNAL ORDER OF POLICE; AND TO DECLARE AN EMERGENCY

 

Body

WHEREAS, agreement has been reached with Capital City Lodge #9, Fraternal Order of Police, for the dredging of the pond on their property at 409 East Johnstown Road in exchange for a slope easement being granted in connection with the Cherrybottom and US 62 intersection improvement; and

 

WHEREAS, money for this dredging work has been encumbered since 1997 and a proposal has been received from Stillion Brothers Excavating to complete the work; and

 

WHEREAS, it is imperative to move toward completion of this as soon as possible; all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Agreement with Stillion Brothers Excavating, 4021 Cole Road, Perrysville, OH  44864 for a one time dredging of the pond on the property of Capital City Lodge #9, Fraternal Order of Police, 409 East Johnstown Road, as outlined in said proposal attached hereto as EXHIBIT A.

 

Section 2.  That Nine Thousand Seven Hundred and Fifty Dollars has been set aside in the 1999 Appropriations to Account Number 101.145.5541, Capital Projects, Streets, to pay for this work.

 

Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
