TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION, FOR ENHANCEMENT FOR THE PLANTING OF DECIDUOUS AND EVERGREEN TREES WITHIN THE EXISTING RIGHT OF WAY OF MORSE ROAD TO ENHANCE THE FIVE-LANE ROADWAY WIDENING PROJECT CURRENTLY UNDER CONSTRUCTION FROM APPIAN WAY TO HAMILTON ROAD; AND TO DECLARE AN EMERGENCY.

WHEREAS, Ordinance 280-93 provided for cooperation with the State for Fra Morse Road, State Job. No. 060300, which is the reconstruction of Morse Road to a five lane pavement, inclusive of related water line, storm sewer, lighting and traffic control work; and
WHEREAS, construction is currently underway from Appian Way to Hamilton Road and the Ohio Department of Transportation is ready to move ahead with the enhancement for the planting of deciduous and evergreen trees within the existing right of way for this project; and
WHEREAS, it is important and necessary that this work be started immediately for the timely completion of this project due to the continuing traffic growth of this quadrant of the community, all for the preservation of the public peace, health, safety and welfare:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into "AN EMERGENCY ORDINANCE ENACTED BY THE CITY OF GAHANNA, FRANKLIN COUNTY, OHIO, IN THE MATTER OF THE HEREIN DESCRIBED IMPROVEMENT AND TO REQUEST COOPERATION BY THE OHIO DIRECTOR OF TRANSPORTATION, said agreement attached to this ordinance as EXHIBIT A.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and upon the date of signature of approval by the Mayor.
