TITLE
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A PRE-ANNEXATION AGREEMENT WITH K C REAL PROPERTY INVESTMENTS, LLC AND TRIVIUM DEVELOPMENT LLC FOR PARCEL 170-000488-00 LOCATED AT 4710 EAST JOHNSTOWN ROAD
BODY
WHEREAS, the City of Gahanna has been approached by representatives of K C Real Property Investments, LLC and Trivium Development LLC regarding a request to annex 4710 East Johnstown Road, Franklin County Auditor Parcel No. 170-000488-00, into the City from Jefferson Township; and
WHEREAS, the parcel, totaling approximately 0.429 acres, is intended to be incorporated into a currently contemplated mixed-use commercial and residential development project further described in Exhibit B of the Pre-Annexation Agreement; and
WHEREAS, upon annexation, all future zoning and development considerations for the property will be reviewed as part of the proposed development and in accordance with all applicable City codes, policies, and state law requirements; and
WHEREAS, the Developer will be required to submit all necessary applications for zoning, planning, engineering, and any applicable incentive approvals associated with the proposed project; and
WHEREAS, the Pre-Annexation Agreement outlining the annexation process, development expectations, and related terms is attached hereto as EXHIBIT A.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. The Mayor is hereby authorized to execute the Pre-Annexation Agreement with K C Real Property Investments, LLC and Trivium Development LLC for Franklin County Auditor Parcel No. 170-000488-00; said agreement attached hereto and incorporated herein as EXHIBIT A.
Section 2. This ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
