TO ACCEPT DEED OF EASEMENT FOR FACADE PURPOSES FOR PROPERTY LOCATED AT 57-63 MILL STREET; FROM MILL STREET INVESTMENT COMPANY LLC.

WHEREAS, the City Attorney has presented a recorded deed to the Council Office from Mill Street Investment Company, LLC for acceptance and filing in the permanent Deed files; and
WHEREAS, a perpetual easement in over and through the exterior surfaces on the southern and eastern facades of 57 Mill Street and on the eastern facade of 63 Mill Street has been given to the City by Mill Street Investment Company; and
WHEREAS, said easement shall be limited to a right of approval by the City to any substantial change to the physical appearance of the aforesaid exterior surfaces only, including but not limited to materials changes, physical appearance, paint and/or stain color, signage and exterior window treatment; and
WHEREAS, this deed of easement was recorded at the Franklin County Recorders Office on October 31, 2003;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement for facade purposes, said Deed attached to this ordinance as EXHIBIT A, and made a part herein.
Section 2. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
