TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH TRICAR LTD., TO PERFORM SOIL AND GROUND WATER SAMPLING, AND DEVELOP BUSTR TIER 1 REPORT FOR THE CLOSING OF THE OKLAHOMA AVENUE FUEL TANK SITE; TO WAIVE THE BID PROCESS; AND TO DECLARE AN EMERGENCY.

WHEREAS, proposal has been received to do necessary work to clean up the fuel tanks at the Oklahoma Avenue complex site; and
WHEREAS, the Director of Public Service has recommended that we proceed to begin the required corrective actions to clean up the fuel tank site; and
WHEREAS, it is necessary to move forward with this project all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Contract with TriCar Ltd., 10477 Shields Road, Ostrander, Ohio 43061, to perform soil and ground water sampling, and develop BUSTR Tier 1 report for the closing of the Oklahoma Avenue Fuel Tank site; proposal attached as EXHIBIT A.
Section 2. That funding in the amount of FIFTEEN THOUSAND THREE HUNDRED DOLLARS ($15,300) was appropriated in the 2002 appropriations, in Account No. 101.141.5533, Service Complex, Capital, to cover the herein costs.
Section 3. That the bid process is hereby waived.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on the date of signature approval by the Mayor.
