Title

TO ACCEPT DEED OF EASEMENT AND DEED OF PUBLIC IMPROVEMENTS FOR 0.025 ACRES BETWEEN 57 AND 63 MILL STREET; AND TO ACCEPT SIDEWALKS, RETAINING WALL, AND STEEL STEPS, IMPROVEMENT NO. 854 AND APPURTENANCES THERETO; FROM MILL STREET INVESTMENT COMPANY LLC.

WHEREAS, the City Attorney has presented a recorded deed to the Council Office from Mill Street Investment Company, LLC for acceptance and filing in the permanent Deed files; and

 

WHEREAS, 0.025 acre is being given to the City for a perpetual nonexclusive easement in, through, over and under an area of land for the purpose of ingress and egress for public use between the Mill House and the Old Bag of Nails Pub, together with the right of access to said easement area for said purpose and title to the brick paver sidewalk, retaining wall and steel steps located on the property; and

 

WHEREAS,  this deed for 0.025 acre on Mill Street was recorded at the Franklin County Recorders Office on October 31, 2003;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That this Council hereby accepts the Deed of Easement and Deed of Public Improvements from Mill Street Investment Company, LLC, for 0.025 acre, more or less, said Deed attached to this ordinance as EXHIBIT A, and made a part herein.

 

Section 2.  That the improvements of the sidewalk, retaining wall, and steel steps and appurtenances thereto, Imp. #854,  in the area of 57-63 Mill Street are hereby accepted.

 

Section 3.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
