AN ORDINANCE TO SET FORTH A STATEMENT OF MUNICIPAL SERVICES TO BE PROVIDED TO THE AREA CONTAINED IN THE PROPOSED ANNEXATION OF 9.997+/- ACRES FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA; REQUESTED BY RICHARD E. CONRAD; AND TO DECLARE AN EMERGENCY

WHEREAS, a Petition for the annexation of 9.9997+/- acres from Jefferson Township to the City of Gahanna has been filed by Richard E. Conrad; and
WHEREAS, a hearing on said Petition is scheduled before the Board of County Commissioners of Franklin County on March 4, 1998; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that before said hearing the Municipal Legislative Authority shall adopt a statement indicating what services, if any, the municipal corporation will provide to the territory proposed for annexation upon annexation, and it is, therefore, necessary to effect this legislation prior to the hearing date for the orderly progression of the annexation procedure, and for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the City of Gahanna will provide the following municipal services for 9.997+/- acres in Jefferson Township upon the acceptance of the annexation of the said area to the City of Gahanna:
POLICE:
1. The tract is not located on a primary thoroughfare.
2. The City of Gahanna provides 24-hour police protection, criminal investigation, and traffic control through the efforts of various segments of the division of police. The Department is comprised of 45 sworn full-time officers, 17 sworn Reserve officers, and 9 civilians.
3. Optimally the Department operates 8 cruisers on patrol throughout the City per shirt; a shift never has less than 5 cruisers on patrol.
4. The entire area is routinely patrolled by the officer assigned to the area in question; anticipated response time to a police emergency is 3 to 5 minutes; non-emergency response if generally 5 to 10 minutes.
5. The City of Gahanna is part of the 9-1-1 Emergency System that allows quick response to emergency situations; the Department anticipates no problems in providing police protection to this area of annexation.
SANITARY SEWER AND WATER:
1. Water service is available from an 8-inch line approximately 300 feet southwest of the property on Harrison Pond Drive. It is understood that any extension of water lines is the responsibility of the owner/developer.
2. Sanitary sewer service is available from a 12-inch main approximately 300 feet southwest of the property on Harrison Pond Drive. It is understood that the extension of the sewer is the responsibility of the owner/developer.
SANITATION SERVICES:
Upon being annexed to the City of Gahanna, the proposed annexation shall receive sanitation services as provided in Chapter 941, Garbage and Refuse Collection, of the Codified Ordinances of the City of Gahanna.
STREETS:
The owner/developer shall be responsible for the installation of internal street patterns, if any. Upon acceptance of these improvements by the City of Gahanna, the City will be responsible for the street and light maintenance.
FIRE:
FIRST RESPONSE FROM: Station 131 - Mifflin Township, 475 Rocky Fork Boulevard, Gahanna. Approximate response time: 4-1/2 - 5 minutes via Clark State Road; 5 - 5-1/2 minutes via Morse Road. Apparatus responding: Medic 131 or Engine 131, and Ladder 131, and/or Rescue 131.
SECOND RESPONSE FROM: Station 121 - Plain Township, 9500 Johnstown Road, New Albany. Approximate response time: 3 - 3-1/2 minutes. Apparatus responding: Medic 121, Engine 121, Rescue 121, or Ladder 121.
THIRD RESPONSE FROM: Station 141 - Jefferson Township, 6620 Havens Corners Road, Blacklick. Approximate response time: 3 - 3-1/2 minutes. Apparatus responding: Medic 141 or Engine 142.
NOTE: Mifflin Township has established funding in 1998's budget program to build an additional fire station in the vicinity of Johnstown Road and Riva Ridge Boulevard (NE section of Gahanna). If this proposed station was in existence today, it would be on the 1st response unit, with an approximate response time of 2 - 2-1/2 minutes.
RIGHT OF WAY - ANNEXATION REQUIREMENT:
In accordance with the adopted Thoroughfare Plan of the City of Gahanna, and pursuant to Section 1109.02 and Section 121.05 of the Codified Ordinances of the City of Gahanna, this property does not border on any principal roadway; therefore, right of way is not required at this time.
Section 2. That the Clerk of Council is hereby authorized and directed to personally deliver a copy of this legislation to the office of the Board of Commissioners of Franklin County before 10:00 a.m. on Wednesday, March 4, 1998.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
