TO AUTHORIZE THE MAYOR TO ENTER INTO CHANGE ORDER AGREEMENT WITH CONIE CONSTRUCTION FOR THE BUCKLES COURT PUBLIC INFRASTRUCTURE EXTENSION; TO REMOVE AND REPLACE UNSUITABLE SOIL; TO SUPPLEMENTALLY APPROPRIATE $52,062; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0217-2011 awarded the construction contract for the Buckles Court Infrastructure to Conie Construction; and
WHEREAS, after work had started on the infrastructure soft spots were found in the soil that would not support the proposed road; and
WHEREAS, the unsuitable soil must be removed and replaced with suitable material; and
WHEREAS, Conie Construction presented proposal to the City to do the work and the City Engineer is recommending we proceed with them; and
WHEREAS, it is imperative to move forward with this ordinance as soon as possible so that construction can resume so that the project can be completed for occupancy this year, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Change Order agreement with CONIE CONSTRUCTION, 1340 Windsor Avenue, Columbus, Ohio 43211, to remove the unsuitable soil under the infrastructure and replace it with material that will support the project for the Buckles Court Infrastructure Project; proposal attached as EXHIBIT A, and made a part herein.
Section 2. That funding in the amount of FIFTY TWO THOUSAND SIXTY TWO DOLLARS ($52,062) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.145.5596, Engineering, Capital Projects/Improvements, to cover the herein costs.
Section 3. That ORD-0001-2012, passed January 2, 2012, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
