AN ORDINANCE TO SET FORTH A STATEMENT OF MUNICIPAL SERVICES TO BE PROVIDED TO THE AREA CONTAINED IN THE PROPOSED ANNEXATION OF 9.3+/- ACRES FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA; REQUESTED BY MARK D. HERMAN, ET AL.; AND TO DECLARE AN EMERGENCY

WHEREAS, a Petition for the annexation of 9.3+/- acres from Jefferson Township to the City of Gahanna has been filed by Mark D. Herman, et al.; and
WHEREAS, a hearing on said Petition is scheduled before the Board of County Commissioners of Franklin County on May 6, 1998; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that before said hearing the Municipal Legislative Authority shall adopt a statement indicating what services, if any, the municipal corporation will provide to the territory proposed for annexation upon annexation, and it is, therefore, necessary to effect this legislation prior to the hearing date for the orderly progression of the annexation procedure, and for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the City of Gahanna will provide the following municipal services for 9.3+/- acres in Jefferson Township upon the acceptance of the annexation of the said area to the City of Gahanna:
POLICE:
1. The tract is located on a major thoroughfare.
2. The City of Gahanna provides 24-hour police protection, criminal investigation, and traffic control through the efforts of various segments of the Division of Police. The Department is comprised of 45 sworn full-time officers, 17 sworn Reserve officers, and 9 civilians.
3. Optimally the Department operates 8 cruisers on patrol throughout the City per shirt; a shift never has less than 5 cruisers on patrol.
4. The entire area is routinely patrolled by the officer assigned to the area in question; anticipated response time to a police emergency is 3 to 5 minutes; non-emergency response if generally 5 to 10 minutes.
5. The City of Gahanna is part of the 9-1-1 Emergency System that allows quick response to emergency situations; the Department anticipates no problems in providing police protection to this area of annexation.
SANITARY SEWER AND WATER:
1. Water service is available from the 12" main along the south side of Johnstown Road. It is understood that any extension of water lines is the responsibility of the owner/developer.
2. Sanitary sewer service will be available from the Triangle north sewer now under construction. This sewer is planned to be installed on the Wilke property along Johnstown Road. It is understood that the extension of the sewer is the responsibility of the owner/developer.
SANITATION SERVICES:
Upon being annexed to the City of Gahanna, the proposed annexation shall receive sanitation services as provided in Chapter 941, Garbage and Refuse Collection, of the Codified Ordinances of the City of Gahanna.
STREETS:
The owner/developer shall be responsible for the installation of internal street patterns, if any. Upon acceptance of these improvements by the City of Gahanna, the City will be responsible for the street and light maintenance.
FIRE:
FIRST RESPONSE FROM: Station 131, Mifflin Township - 475 Rocky Fork Boulevard, Gahanna. Approximate response time: 3 - 3-1/2 minutes. Apparatus responding: Engine 131 or Medic 131, Ladder 131, and/or Rescue 131.
SECOND RESPONSE FROM: Station 121, Plain Township - 9500 North Johnstown Road, New Albany. Approximate response time: 4-1/2 - 5 minutes. Apparatus responding: Engine 121 or Ladder 121, and Medic 121 and/or Rescue 121.
THIRD RESPONSE FROM: Station 141, Jefferson Township - 6620 Havens Corners Road, Blacklick. Approximate response time: 5 - 5-1/2 minutes. Apparatus responding: Engine 141 or Medic 141.
Note: Mifflin Township is proposing to build a new fire station (Station 133, an already budgeted item for 1998) in the vicinity of Johnstown Road, most likely between Dark Star Avenue and Riva Ridge Boulevard. If this proposed fire station was in existence today, it would be on the first response alarm with an approximate response time of 1/2 - 1 minute.
RIGHT OF WAY - ANNEXATION REQUIREMENT:
In accordance with the adopted Thoroughfare Plan of the City of Gahanna, East Johnstown Road is designated as a minor arterial roadway. Pursuant to Section 1109.02 of the Codified Ordinances of the City of Gahanna, a minor arterial right of way shall be 80 feet. The required right of way would be 40 feet from the center line, which is an additional 10 feet, plus the property which is currently occupied by the road.
Section 2. That the Clerk of Council is hereby authorized and directed to personally deliver a copy of this legislation to the office of the Board of Commissioners of Franklin County before 10:00 a.m. on Wednesday, May 6, 1998.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
