APPROVING FORMATION OF THE GAHANNA TAX INCENTIVE REVIEW COUNCIL, APPOINTING AND APPROVING THE INITIAL TRUSTEES OF SUCH COUNCIL, AND DECLARING AN EMERGENCY.

WHEREAS, the City Council has requested the formation of a Tax Incentive Review Council pursuant to Section 5709.85 of the Ohio Revised Code; and
WHEREAS, such a Council is to be formed and is to be known as the Tax Incentive Review Council; and
WHEREAS, Ohio Revised Code Section 5709.85 provides for the composition of the Board in that the Chief Executive Officer or his designee, a member of the legislative authority, the chief financial officer of the municipal corporation or his designee, the county auditor or his designee, an individual appointed by the board of education of each city, local, exempted village, and joint vocational school district affected, and two members of the public appointed by the chief executive officer of the municipal corporation with the concurrence of the legislative authority shall serve on this Council; and
WHEREAS, an emergency exists since the immediate preservation of the public peace, health, safety and welfare in the City requires the approvals and determinations contained herein to be effective at the earliest possible date;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. The under authority of Section 5709.85 of the Ohio Revised Code the Tax Incentive Review Council is hereby established.
Section 2. That pursuant to Section 5709.85(A)(1) of the Ohio Revised Code the initial members of said Council, statutory appointments shall be:
Mayor (Chief Executive Officer)
President of Council (Legislative Authority)
Director of Finance, City of Gahanna (Chief Financial Officer)
Franklin County Auditor (County Auditor)
Gahanna Jefferson Schools (Local School District)
Eastland Career Center (Joint Vocational School District)
Section 3. That pursuant to Section 5709.85(A)(1) of the Ohio Revised Code the initial members of said Council appointed for 3 year terms ending December 31, 2002 as residents representing the general public appointed by the Mayor and hereby confirmed by this Council shall be:
Robert E. Froman, 325 Dellfield Way, Gahanna, Ohio 43230
Ernest Kelly, 626 Bonnington Way, Gahanna, Ohio 43230
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
